Terms and Conditions: Win the Ultimate Anaheim Experience with Viva
- The promoters are both jointly NZME Publishing Limited (publishers of Viva.co.nz), 2 Graham Street, Auckland 1010 & Visit Anaheim (together being the "Promoter").
- The completion and submission of details and the keyword as required under paragraph 7 of these terms and conditions is deemed acceptance of the terms and conditions of entry in relation to the Competition.
- Information on how to enter the Competition and prizes form part of these terms and conditions. Any entry not complying with these terms and conditions is invalid.
- Subject to paragraph 5 of these terms and conditions, entry is open to all New Zealand residents over 18 years of age.
- Employees (and their immediate families) of the Promoter(s) and their agencies associated with the Competition are ineligible to enter.
- The Promotion commences on Wednesday 27th September 2017 and closes on Tuesday 10th October at 4pm (“Competition Period”).
- To enter the Competition, entrants must go to the webpage [www.viva.co.nz/win and enter their details in the space provided along with the keyword "Anaheim" (within the Competition Period).
- The entry for this Competition is limited to 1 per person (per email address).
- The Prize consists of the following:
- 2 x Premium Economy class return flights to Los Angeles, plus domestic flights to and from Auckland if the winner lives outside of Auckland. Flights are valid for 1 year from the date of the draw, and are subject to availability. Once booked, flights are non-transferable and non-refundable and cannot be exchanged for cash;
- Shuttle transfers
- 5 nights’ accommodation at the Hyatt Place at Anaheim Resort/Convention Centre, offer applies Sunday through Thursday;
- A visit to the Anaheim Brewery and Anaheim Packing House with dining vouchers;
- A day trip to Catalina Island and the chance to Zip-line;
- A visit to Laguna and Huntington Beaches;
- 2 x tickets to either a baseball or ice-hockey game;
- A $400 Burke Williams Spa gift card;
- 2 x five-day ART passes; and
- A Shop Until You Drop Off at LAX VIP experience at Citadel Outlet Mall
- All prize components listed above are valid for 1 year from the date of drawing (12th October 2017) and are subject to availability and close out dates. Prizes are non-transferable, non-refundable and cannot be exchanged for cash.
- The winner of the Competition will be drawn from all valid entries submitted during the Competition Period. The winner of the Competition will be drawn on Thursday 12th October 2017 at the NZME, 2 Graham Street, Auckland 1010.
- The winner will be notified by phone on or before 5pm on Friday 13th October 2017. If the winner cannot be contacted, or the winner is unable to redeem the prizes for whatever reason, the entries will be re-drawn. No compensation will be payable to a winner who cannot be contacted or who cannot redeem the Prize for whatever reason.
- If the winner lives outside of Auckland, travel arrangements to and from the winner's residence to the domestic airport does not form part of the Prize and are the responsibility of the winner.
- Unless explicitly stated in paragraph 9 of these terms and conditions, all costs incurred by the winner, and any other expenses incurred while redeeming the Prize, will be at the expense of the winner.
- In accepting the Prize, the winner agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winner agrees to grant the Promoter a perpetual and non-exclusive license to use such footage and photographs in all media (including the Promoter's Facebook page) and the winner will not be entitled to any fee for such use. The winner may be required to confirm their agreement to these terms and conditions again before receiving the prize.
- Each entrant acknowledges and agrees that:
- The Competition is administered by the Promoter; He / she is providing information to the Promoter and the Promoter may disclose such information to any third party as required by law; and
- To the fullest extent permitted by law, the Promoter (including its officers, employees, and agents), will not be liable in any way (including negligence) for any loss or damage (including the loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition.
- The Promoter expressly reserves the right to resolve any discrepancies, disputes or otherwise unforeseen circumstances as it deems fit and the Promoter's decision will be final and binding. No correspondence will be entered into. The Promoter expressly reserves the right to change or alter these terms and conditions at any time.
- The Promoter reserves the right to refuse to award the Prize to any entrant who the Promoter (in its sole discretion) believes has gained an unfair advantage in participating in the Competition or won using fraudulent means. All entries are deemed received at the time of receipt NZME’s database and NOT at time of transmission by the entrant. NZME’s records are conclusive as to time of receipt. Late, misdirected, illegal, incomplete or illegible, are invalid. NZME is not responsible for such entries nor for any error, technical malfunction, loss, omission, communications delay or failure.
- The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained by the winner as a result of entering the Competition and accepting the Prize, except for any liability that cannot be excluded by law.
- If the Competition is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or ALC-296756-21-3-V1 proper conduct of the Competition, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the Competition or to disqualify any individual who has tampered with the entry process.
- In accordance with the Privacy Act 1993, NZME Publishing Ltd collects personal information and NZME Publishing Ltd holds personal information to conduct the promotion, notify prize winners, verify prize winners' identities and may be used by NZME Publishing Ltd, and Visit Anaheim for future promotional activities, including (where consented to) sending the entrant emails. Individuals have rights to access and request correction of their personal information held by NZME
- Publishing Ltd, and Visit Anaheim.
- Entrants and e-newsletter subscribers are identified by the email address used to subscribe. Any prize won by a web entrant will be awarded to the holder of the email address (or that person’s parent/guardian if the winner(s) is/are under 18 and the nature of the prize requires the winner(s) to be over 18 years of age) from which that entry was submitted. The Promoter takes no responsibility for disputes resulting from email newsletter subscriptions and entries submitted using an email.
